Garrigae Investissements or any of its subsidiaries will not be considered liable for any inaccuracies contained within, and compensation for inaccuracies will not be paid.
Article 1 - REGISTRATION AND RESERVATIONS
The customer shall acknowledge the additional practical and technical information provided for his stay and adhere to the booking conditions for Le Couvent.
1.1- Information required prior to Reserving
1.1.1. - Number of People
Upon reserving, you will be asked for the exact number of people, their surname and first name, and the age of the children who will reside on the premises during your stay.
Each Suite is designed and insured for a maximum number of people, as indicated in the description. Any additional guests must be authorised by Garrigae Hotels & Resorts and a supplement may be payable.
1.1.2 - Pets
We regret to inform you that pets are not allowed in the Residence.
1.1.3 - Special personal Circumstances
Any special requirements must be indicated upon booking. Please note the accommodation does not have wheelchair access.
1.2 - Registration and Reservation
To be considered firm, the registration shall include a payment of:
A deposit equal to 30% of the total amount of your rental and potential additional services, or 100% if your arrival date is less than 30 days away.
1.3 - The Reservation Contract takes effect upon receipt of payment as detailed above (1.2) and the reservation form, duly completed and signed.
1.4 - Balance Payment
Further to the deposit payment of 30%, the balance for the stay is due 30 days before the arrival date. Garrigae Hotels & Resorts have the right to cancel the booking should the balance not be paid. The cancellation procedure as detailed in 4.1 will then be followed.
1.5 - Confirmation and Accommodation Documents
Upon receipt of your payment of the outstanding balance, we will confirm your reservation, the type of accommodation and various options and services recorded. Should an error or omission occur, please let us know.
Article 2 - PRICES & PAYMENT
2.1 - Prices
Prices are set out in Euros and will be confirmed when you reserve your suite and your deposit payment has been paid. The price is only subject to changes should the French VAT rates change between the date of your reservation and the date that your balance payment is due.
The price includes your stay as indicated on your booking form, use of the hotel's facilities and it does not include any treatments at the Couvent Spa, purchases from the Couvent or any additional services.
Article 3 - MODIFICATIONS
3.1 - Potential Modifications to our Services
If required by circumstances and only in the case of force majeure events independent of our will or for safety or maintenance reasons, we may be obliged to partially or totally change our services (total or partial closure of the site, common equipment, etc.). If said change is known at the time of the reservation, Garrigae Hotels & Resorts shall inform the customer thereof.
3.2 - Modifications by Garrigae Hotels & Resorts
Should we be obliged, before the customer's arrival, to modify one of the essential items of the contract, the customer may, after notification by registered letter with acknowledgment of the receipt:
Either terminate the contract with an immediate refund of sums paid with no penalty,or accept the modification proposed by Garrigae Hotels & Resorts. The amended contract shall then be signed by both parties.
3.3 - Modifications by the Customer
Should the customer wish to change his reservation once it has been confirmed, we will do our best to adhere to the changes. If the changes are not possible then the cancellation procedure as detailed in 4.1 will be followed.
Article 4 - CANCELLATION
4.1 - Cancellation Procedure
All cancellations must be notified by registered letter with acknowledgement of receipt and the date of receipt shall constitute the cancellation date. This said date shall be used as the basis for calculating the cancellation fees.
An indemnification invoice will be calculated on the total amount of the accommodation reserved according to the following scale:
More than 45 days: deposit reimbursed
44 to 30 days before departure: 30% ie deposit forfeited
29 to 21 days before arrival: 45% forfeited
20 to 8 days before arrival: 75% forfeited
7 to 3 days before arrival: 90% forfeited
Up to 2 days before arrival: 100% forfeited
Cancellation may be caused by a force majeure event and we therefore recommend you purchase personal cancellation insurance.
4.2 - Interruption of the Stay
The customer shall not claim an indemnity or reimbursement should he shorten or interrupt his stay for any reason whatsoever, including a strike, medical repatriation and any other force majeure event. Again, we recommend you purchase personal cancellation insurance. The customer must pay any outstanding balances of the booking and additional expenses resulting from the termination to Garrigae Hotels & Resorts.
Article 5 - THE STAY
5.1 - Arrival and Departure Times
Accommodation is made available to the customer at 3:00 pm. On the date of departure, accommodation must be vacated by 11 am. All occupation in excess of these schedules may give rise to additional charges.
The customer must inform the site's reception of a late arrival.
5.2 - Surety Deposit
A surety deposit, which is variable in accordance with the type of accommodation, shall be requested upon arrival. This deposit shall be returned to you at the end of your stay subject to the suite being left in an acceptable state. The occupants are deemed to have taken possession of the suites in a perfect state and equipped with the items listed in the inventory provided to them at the time of arrival.
They shall, at the time of departure, leave the suites in the same condition as it was on their arrival with identical items as those set out in the inventory.
The following are deemed to be missing items or damage: A kitchen and its contents that cannot be used by another occupant without cleaning. The obvious absence of usual care in terms of cleanliness. An additional cleaning charge may then be payable. The customer shall be responsible for any broken or damaged item and damages that may have been caused to the installations. A lost key shall be invoiced €10 to the customer. All related expenses (telephone, options, restaurant extras, etc. that are not included in the reservation form) shall be paid at the end of the stay at the site's reception.
5.3 - Outside Guests
The Couvent site is private property and reserved for its customers.
Any request to invite an additional guest shall be made to reception. In no event may additional guests benefit from events and activities without authorisation and an additional charge may be payable.
5.4 - Accommodation Regulations For practical purposes, accommodation regulations are on display at reception; please acknowledge and comply with these regulations.
Disturbances: each contracting tenant is responsible for disturbances caused by persons using the accommodation. If a resident disturbs other residents or causes damage to the accommodation, his stay may be immediately terminated without indemnity and without prejudice to claims for reparation that Garrigae Hotels & Resorts and third parties may engage against him.
5.5 - Inventory
The suites are fully equipped with china, cutlery and beds It is expressly prohibited to use the beds without sheets. The customer shall, in his own interest, check the premises and inventory upon arrival, as well as the proper operations of the household appliances and washrooms. He shall check and inform reception of any deficiency within 48 hours. No claim thereafter shall be considered.
5.6 - Damages
The Couvent's installations and equipment shall be used in accordance to their instructions. Any damage to the premises or destruction of items that furnish the residences or common buildings are the full responsibility of the tenant. The contractual tenant is personally responsible for all damages, loss or degradation both to the rental and the site itself caused by persons staying with him or visiting him.
Article 6 - LIABILITY & CLAIMS
6.1 - Liability
Garrigae Hotels & Resorts declines any liability in the case of damage to or theft of personal belongings in the accommodation units or common areas.
We decline liability for disturbances resulting from force majeure events that may disturb, interrupt or prevent your stay.
The customer shall ensure that he has purchased multi-peril and civil liability insurance from a company known to be solvent, which he shall be in a position to provide at Garrigae Hotels & Resorts' first request. Pursuant to Article 1792 of the Civil Code, the customer is responsible for all goods (automobiles, baggage, cameras, jewelry, silver, etc.) under his care. It is therefore incumbent upon the customer to take all measures required to ensure their safety. He shall also comply with the site's Internal Regulations (see Article 5.4).
6.2 - Claims ⁄ Complaints
Any potential claim during the stay must be immediately notified to the Couvent Manager and set out in writing in a specific document made available to him so that we may solve the problem as soon as possible. Should the problem not be solvable on site or if compensation is required, written compensation shall be proposed by the Site Manager and signed by the customer.
Failure to inform the Manager shall cause the stay being considered as having been appropriate and no claim shall be considered.
The customer shall not claim an indemnity in the case of urgent repairs required during his stay within the accommodation.
6.3 - Jurisdiction
The parties elect as their domicile the headquarters of Garrigae Hotels & Resorts, i.e. in Beziers, and recognize the Courts of First Instance of Beziers as having jurisdiction.
This document has been the subject of the greatest care. However, a few non-essential errors may exist and in no way affect the present conditions.
Additionally, we draw your attention to the fact that the photos are in no way contractual and we decline any liability in relation thereto. They should be considered simple illustrations only.
